A food license is an extremely important aspect of the food industry since it is confirmation that what you are selling to your customers is of the highest quality. The law requires that you have a license. It is necessary to pass legislation on safety and cleanliness in order to supply hygienic meals to the public. Before launching a food business in India, it is critical to complete the food license registration process.

FSSAI Definition

The Food Standards and Safety Authority of India is the principal entity in charge of overseeing and monitoring food safety (FSSAI). Every business in the food industry must complete the FSSAI simple registration process.

You will provide information about your company’s type, product section or formulation, manufacturing size, and so on when you register. FBOs (food business operators) are required to report any modifications to India’s food safety and standards administration within a certain time frame (FSSAI).

Food registration with the FSSAI is required for anybody who prepares food and anyone who serves it at various levels before it reaches the consumer, such as raw materials, packaging, production, and delivery to canteens, as well as companies with marketing authority. It is required for those who provide services to others from their houses. You must register with the FSSAI as long as you are earning money from it. 

There are several types of licenses

Businesses with a revenue of less than Rs. 12 lacs can apply for a basic FSSAI food safety registration, while those with a turnover of more than Rs. 12 lacs but less than Rs. 20 lacs can apply for a state license, and those with a turnover of more than Rs. 20 lacs can apply for a central license.

Changes, transfers, and modifications to the license

If the FSSAI license has already been issued, you will need to go through a series of steps to change it. An application to amend the FSSAI license or registration must be filed. FSSAI registration is sufficient for small businesses, while an FSSAI license is required for large-scale food businesses. But what happens if the FSSAI holder passes away?

A legal representative or any family member of the person who died with the FSSAI license can receive the FSSAI license. The legal family member or agent should request that the certificate be transferred to the appropriate authorities in his or her name. After thorough verification, the authority may deny or approve the application. Despite this, the FSSAI license authority cannot reject the application without giving the claimant a chance to be heard.

The FSSAI license would only continue if the legal agent or any family member applied to transfer the certificate in the event of a registered certificate or license holder’s death. If the FSSAI certificate is not renewed within three months of the holder’s license or registration certificate expiring, it will expire.

The procedure for requesting a license transfer

To transfer a license, go to the official website and log in using the credentials listed below:

Step 1: To apply for the transfer of a specific license, go to ‘duplicate/surrender/transfer of license(s).’ Click on ‘apply for duplicate/surrender/transfer of license(s)’ from the drop-down menu as shown below.

Step 2: To apply for a license transfer, click on the ‘transfer’ button next to the license number that appears on the screen.

Step 3: Fill in the essential information and click Next to proceed.

Step 4: The transfer application will be filed to DO’s account for further procedure once you click “continue.”

How do you go about transferring a certificate?

Step 1: Click on ‘duplicate/surrender/transfer of certificate(s)’ to apply for a specific certificate transfer. and select ‘apply for duplicate/surrender/transfer of certificate(s)’ from the drop-down box.

Step 2: To apply for a license certificate transfer, click on the ‘transfer’ button next to the license number that appears on the screen.

Step 3: To proceed, fill in the relevant information and click on it.

Step 4: The application for the certificate transfer will be filed to RA’s account for further procedure once you click the proceed button.

The license or certificate will be transferred according to the request once the entire application has been filed without any concerns or objections.
